User Agreement On the Use of NSK Product Cross-reference System

The NSK Product Cross-Reference System, including the 'Bearing Cross-Reference' and 'Linear Guide Cross-Reference', and all information and software contained therein (collectively, the "System"), is owned and operated by NSK Americas, Inc. ("NSK"). By accessing and using this System, you (the "User"), agree to be bound by the terms and conditions contained in this User Agreement for the NSK Product Cross-Reference System (the "User Agreement"). If User does not agree to all the terms and conditions contained in this User Agreement, User shall not be allowed access or use of the System. NSK reserves the right to make changes, in its sole discretion, to the User Agreement and the System at any time without prior notice to User. Use of the System after any changes have been made by NSK indicates User´s acceptance of the changes.

The System is subject to copyright, trademark and other intellectual property laws. All information, including text and graphics, contained in the system is the property of NSK, or others as indicated. No part of the System may be copied, displayed, distributed, downloaded, licensed, modified, published, reverse engineered, reproduced, sold, transmitted, used to create a derivative work or otherwise used for public or commercial purposes without the express written permission of NSK or appropriate holder of copyright, trademark or other intellectual property right. User acknowledges that unauthorized use of the System may subject User to liability under copyright and other applicable laws.

The User is granted access to the System for personal informational purposes only, and information obtained from the System is to be used for such purposes only. User is expressly forbidden from using the System in any manner other than the uses designated by NSK. Use of the System for any marketing, competitive, or other commercial use is in violation of NSK´s designated usage.

The information presented in this System is provided by NSK solely as a convenience to its current and future customers and authorized distributors and is believed to be current and accurate as of the date last indicated; however, if any information becomes out of date, NSK makes no commitment to update the information. NSK does not represent that use of the System will be uninterrupted or free of errors, or endorse the accuracy, adequacy, reliability or completeness of any information distributed through, or linked, downloaded or accessed from the System. Any and all liability for the informational content or any omissions in information, including any inaccuracies, errors, or misstatements in such information, is expressly disclaimed.

THE SYSTEM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. NSK HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR OF ANY OTHER NATURE WITH RESPECT TO THE SYSTEM OR THE PRODUCTS TO WHICH THE SYSTEM REFERS.

IN NO EVENT SHALL NSK BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, CONSEQUENTIAL DAMAGES AND THOSE RESULTING FROM LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF INFORMATION PRESENTED ON THE SYSTEM, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT NSK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SUBJECT TO APPLICABLE LAW, NSK HEREBY DENIES ALL RESPONSIBILITY FOR PERSONAL OR PROPERTY INJURY OR DAMAGE DUE TO NSK´S NEGLIGENCE. WHERE APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, OR FOR LIMITATIONS OF LIABILITY CONCERNING DEATH OR PERSONAL INJURY, SUCH EXCLUSIONS MAY NOT APPLY.

If use of the System results in the need for servicing, repair, replacement or correction of User´s equipment or software, including introduction of any viruses, User assumes responsibility for all costs of servicing, repair, replacement or correction of such equipment and software.

Information provided on the System may refer to material and or services that are not available in your country or local area. An NSK sales office or NSK authorized distributor should be contacted for further information before relying on any information contained in the System.

Use of the System for illegal activities of any kind, including unauthorized use (or attempted use) of NSK´s website, is strictly prohibited.

The User Agreement and all matters related to the System shall be governed by and interpreted in accordance with the laws of the State of Michigan, USA, without giving effect to its principles of conflicts of law. All claims or disputes arising out of or relating to use of the System shall be heard exclusively in the state or federal courts located in the State of Michigan, USA. User consents to personal jurisdiction in such courts and hereby expressly waives any objections on grounds of improper venue or forum non conveniens.

Where applicable, if any provision of this User Agreement is deemed unlawful, void or otherwise unenforceable for any reason, that provision shall be severed and the remaining provisions of the User Agreement shall remain in full force.
